1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the ElastoMERIT mobile application (the "App"), developed and published by Orthologic Technologies LLC, a North Carolina limited liability company ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

If you are a parent or legal guardian creating or consenting to an account on behalf of a minor, you agree to these Terms on behalf of yourself and, where applicable, your child.

2. Eligibility and account types

The App supports three account types: patient accounts, parent/guardian accounts, and provider accounts. By creating an account, you represent that all information you provide is accurate and that you fall into one of the following categories:

3. Children and parental consent

Users under the age of 13 may create their own patient account, but the account will not be fully functional and no personal information will be collected, used, or stored until verifiable parental consent has been provided, consistent with our Privacy Policy and applicable law (including the Children's Online Privacy Protection Act). Parents and guardians are responsible for supervising their child's use of the App and may revoke consent or request account deletion at any time as described in our Privacy Policy.

Users between the ages of 13 and 17 may generally create and manage their own account, but we encourage parental involvement and the App provides an optional parent-linking feature for this purpose.

4. Description of the app

ElastoMERIT is a habit-tracking and reminder tool designed to help patients improve consistency with prescribed orthodontic elastic wear. Features may include reminders, a habit-tracking calendar, an optional photo-based check-in feature, a rewards system, and optional connectivity with a parent and/or treating provider. Features are subject to change, and we do not guarantee that any specific feature will remain available indefinitely.

5. Not a substitute for professional care

The App is not a medical device and does not provide medical or dental advice, diagnosis, or treatment. ElastoMERIT is a compliance-tracking and reminder tool only. All decisions about your orthodontic treatment, including the type, duration, and manner of elastic wear, must be made in consultation with your treating orthodontist or dental professional. Never disregard professional dental or medical advice, or delay seeking it, because of information provided through the App.

If a provider account holder enters prescription information into the App, that information is provided by the treating professional for the patient's reference and convenience; it does not replace direct communication with your treating provider regarding your treatment plan.

6. Account responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly at diffeeh@gmail.com if you become aware of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account that occurs due to your failure to safeguard your credentials.

7. Account linking between patients, parents, and providers

The App allows a patient account to be linked to a parent account and/or a provider account, enabling limited, feature-specific data sharing as described in our Privacy Policy. By initiating or accepting a link, you consent to that specific category of information sharing. You may unlink an account at any time through the App's settings, which will stop further data sharing with that account going forward.

8. Provider account terms

If you create a provider account, you represent that you are a licensed dental or orthodontic professional, or are acting under appropriate supervision in a clinical setting. You agree to:

The App allows patients to optionally upload photos as part of a compliance check-in feature. You retain ownership of any photo you upload. By using this feature, you grant us a limited license to store and display that photo back to you (and, where applicable, to your linked provider) solely for the purpose of operating this feature, as described in our Privacy Policy. We do not use your photos for any other purpose, including marketing, and we do not share them with any third party.

You agree not to upload any photo that is unlawful, depicts any person other than yourself without their consent, or otherwise violates these Terms.

10. Rewards feature

The App's rewards feature allows patients to earn in-app recognition (such as stars) and allows parents or providers to optionally configure custom incentive descriptions visible to a linked patient. The App itself does not provide, fund, fulfill, or guarantee any reward. Any reward arrangement described within the App is solely between the patient and the parent or provider who configured it, and we are not a party to and bear no responsibility for the fulfillment of any such arrangement.

11. Research participation (if applicable to you)

The App is a standalone consumer product. If you are also participating in an Institutional Review Board (IRB)-approved research study that uses the App as one of its tools, your participation in that research is governed entirely by the separate informed consent or assent form, and, where applicable, HIPAA authorization, that you signed directly with the research team. These Terms govern only your use of the App itself and do not modify, limit, or expand any right or obligation created by a separate research consent document. In the event of any conflict between these Terms and a signed research consent document specifically applicable to you, the research consent document controls with respect to research-related matters.

The App, including its design, features, graphics, and underlying software, is owned by Orthologic Technologies LLC and is protected by applicable intellectual property laws. Except for the limited right to use the App as permitted by these Terms, no other rights are granted to you. You may not copy, modify, distribute, sell, or lease any part of the App without prior written permission.

14. Disclaimers

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or completely secure, or that it will improve treatment outcomes or compliance for any particular user.

15. Limitation of liability

To the fullest extent permitted by applicable law, in no event shall orthologic technologies llc be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the app, even if advised of the possibility of such damages. Our total cumulative liability arising out of or related to these terms or the app shall not exceed fifty u.s. dollars ($50).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Orthologic Technologies LLC from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of another person or entity, except to the extent such claims arise from our own gross negligence or willful misconduct.

17. Termination

You may stop using the App and delete your account at any time as described in our Privacy Policy. We may suspend or terminate your access to the App if you violate these Terms, if required by law, or if we discontinue the App. We will make reasonable efforts to provide notice before discontinuing the App where practicable.

18. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the App or by other reasonable means before the changes take effect. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

19. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws principles, unless otherwise required by the mandatory consumer protection laws of your jurisdiction of residence. Any dispute arising out of or relating to these Terms or the App shall be resolved in the state or federal courts located in North Carolina, and you consent to the personal jurisdiction of those courts.
